1. Scope
These terms apply to the use of Artist Brain, provided by Harbour Intelligence GmbH("we"). Artist Brain is offered to businesses, for example artist management companies, agencies and self-employed artists, and not to consumers. Deviating terms of a user only apply if we agree to them in writing.
2. Alpha
Artist Brain is in alpha. It is currently free of charge. Features may change, be added or removed, and there may be errors or interruptions. We will announce paid plans in good time; they will only apply if you agree to them.
3. Account
You sign in with your email address or your Google account. Keep access to your email account secure, because whoever can read it can sign in as you. You are responsible for activities under your account. Tell us immediately if you notice any misuse.
4. Teams and permissions
Content in Artist Brain belongs to a team. Whoever administers a team decides who is a member and which permissions each member has. Members can see and change content according to these permissions. Make sure that only people who should have access are members of your team.
5. Your content
You keep all rights to the content you upload. You grant us the rights needed to store, process and display it for you and your team, and nothing more. You are responsible for your content, in particular for having the right to use it and, where it contains personal data of others (for example contacts or guest lists), a legal basis for processing it. Where we process such data on your behalf, we conclude a data processing agreement with you on request; write to kontakt@harbour.de.
6. Acceptable use
- Do not use Artist Brain for unlawful content or purposes.
- Do not try to access teams or data you have no permission for, or to circumvent security measures.
- Do not put an unreasonable load on the service, for example with automated mass requests.
We may suspend accounts that violate these rules. Where reasonable, we warn you first.
7. AI features
AI features read documents and answer questions automatically. Their results can be incomplete or wrong. Check them before you rely on them, especially for contracts, dates and amounts. AI features are only used after your consent; details are in the Privacy Policy.
8. Public links
If your team shares its EPK or you share your contact card, everything on it can be seen by anyone with the link. You decide what is shared and can withdraw the link at any time.
9. Availability and data
We work to keep Artist Brain available and your data safe, but during the alpha we do not guarantee a particular availability. Keep your own copies of important documents.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are only liable for breach of an essential contractual obligation (one whose fulfilment makes the proper use of Artist Brain possible in the first place and on which you may regularly rely), and limited to the typical, foreseeable damage. Otherwise our liability is excluded, in particular during the free alpha.
11. Ending use
You can stop using Artist Brain at any time and ask us to delete your account. We can end the service or your access with reasonable notice, and immediately for good cause. Before we end the service, we give you the opportunity to export your content. You can request an export of your team's content at any time by email.
12. Changes to these terms
We may change these terms for good reason, for example new features or changes in the law. We will inform you by email at least 30 days before the changes take effect. If you do not object within this period, the changed terms apply; we will point this out in the notice.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for merchants is Düsseldorf. Should a provision be invalid, the remaining provisions remain unaffected.
